Auction Terms & Conditions

  1. ALL SALES ARE FINAL. ALL ITEMS ARE SOLD "AS IS-WHERE IS," WITH ALL FAULTS AND WITHOUT WARRANTIES.
     
  2. All auction sales will be recorded. This audio record of the number of the bidder, the bid, and amount thereof shall be prima facie evidence of the circumstances of the sale, and all disagreements will be resolved with this record.
     
  3. Catalog descriptions are NOT GUARANTEED. The catalog has been prepared from information believed to be reliable and every effort has been made to ensure accuracy; however, the state is not liable for any errors, omissions, or inaccuracies in the catalog, and no sale shall be invalidated due to any inaccuracy. Bidders are responsible to thoroughly inspect before bidding and to satisfy themselves of such matters as year, make, model, or condition.
     
  4. The State of Washington reserves the right to reject any and/or all bids.
     
  5. The State of Washington reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed.
     
  6. The State is not responsible for any loss or damages of auction items not removed by Purchaser from the auction site by close of business on day of sale. If the purchaser at his sole option elects to leave equipment on the site after close of business he does so at his own risk and accepts full responsibility for any loss or damage.
     
  7. DEPOSITS
    1. For each item purchased, a down payment of one hundred dollars ($100.00) in cash, personal check or Credit/Debit card (Visa or MasterCard only) is required at time of award. This deposit is partial payment and holds vehicles pending receipt of amount due. U.S. FUNDS ONLY.
       
    2. Deposit (holding fee) will be retained as liquidated damages unless payment is made prior to 4:30 PM, on the following Wednesday.
  1. PAYMENTS AND REMOVAL
  1. An $85.00 Buyers Fee will be applied to each vehicle/item purchased.
     
  2. Payments must be made in full prior to release of vehicles or other property. U.S. FUNDS ONLY.
     
  3. Full amount of bid may be made Monday thru Wednesday, 8:00 AM to 4:30 PM, following date of sale at sale site.
     
  4. Payment must be made in CASH, CASHIERS CHECK, MONEY ORDER OR CREDIT/DEBIT CARD (Visa or MasterCard only) for full amount owed. Personal checks for full payment accepted ONLY with a LETTER FROM AN AUTHORIZED BANK STATING THAT THE BANK WILL GUARANTEE OR HONOR THE CHECK UP TO A SPECIFIC AMOUNT. EXAMPLE: the account of (customer's name) is in good standing and we will guarantee (or honor) checks up to the amount of (dollar figure) for the purchase of State of Washington property at the (date) state auction.
     
  5. ALL CHECKS ARE TO BE MADE PAYABLE TO: SURPLUS PROGRAMS
     
  6. All items must be removed by the following Wednesday. A storage fee of $25 per day will be charged on every item not removed by the following Wednesday. Removal costs are the responsibility of the purchaser.
  1. TAXES: STATE USE TAX on titled items will be collected upon title transfer. On all purchases of non- titled items sales tax will be collected from those who do not have a resale tax number. (PROOF REQUIRED)
     
  2. VEHICLE PERMITS: Three-day vehicle trip permits can be purchased from this office for $25.00.
     
  3. Bidders failing to comply with the above Terms of Payment and Removal may be removed from the bidder list. In addition, future bids from those bidders not in compliance with the Terms and Conditions of sale may not be accepted by the office. (RCW 43.19.1911 & RCW 43.19.1913)

NOTE: Condition of items offered is NOT GUARANTEED. Deficiencies, when listed by the owning agencies, are indicated in the item description, however, absence of deficiencies in the item description DOES NOT MEAN the item may not have deficiencies. BIDDERS ARE CAUTIONED TO THOROUGHLY INSPECT PRIOR TO BIDDING.
